These general business and sales conditions consist of the sales conditions as well as the house rules of the Actioncenter.

1. Scope of application
1.1 Unless expressly agreed otherwise in writing, all offers, orders, purchases, reservations as well as all contractual relationships resulting therefrom are subject to these General Terms and Conditions. Deviating conditions of the customer or partner shall not apply unless the Actioncenter has expressly agreed to their validity in writing.
2. Reservation of the service
2.1 The packages, activities and prices offered by the Actioncenter are communicated via the website or by e-mail and are generally considered binding. However, the Actioncenter reserves the right to correct obvious spelling, calculation or technical errors at any time.
2.2 The prices valid on the day of the event always apply plus the applicable statutory VAT.
2.3 Upon receipt of the deposit by the Actioncenter, the reservation is considered bindingly confirmed. Reservations without a deposit requirement become binding upon sending the reservation confirmation. The remaining balance must be paid on site at the latest before the start of the activities. Payment can be made in cash, by bank or credit card, or by means of a valid voucher.
2.4 Orders with and without a deposit requirement are subject to these GTC.
2.5 The deposit will ultimately be deducted from the total amount.
3. Change or cancellation
3.1 Changes or cancellations must be requested in writing and within the deadline:
• More than 14 days before the event may be cancelled free of charge or changes to the number of persons, activities or food orders may be made.
• For changes or cancellations 14 to 7 days before the event, 50 % of the cancelled participants, activities or food orders will be charged.
• For changes or cancellations up to 48H before the booking, 100 % of the participants, activities and food orders previously confirmed by the Actioncenter will be charged.
•If more people come than originally specified and it fits into our planning, this will be charged on the day of the activities and charged additionally, at the prices valid on the day of the event. If more people come than originally specified and it does not fit into our planning, unfortunately nothing can be done.
4. Invoice
4.1A receipted invoice can be issued in the days following the event. For this we require all company details including the VAT identification number. On the day of the event, the reception must be informed that an invoice sheet should be created. This sheet serves as an invoice template and is absolutely necessary.
4.2 The remaining balance must in any case be paid on site, both by private customers and companies. Payments on account remain an exception and must be agreed in writing with the Actioncenter in advance.
4.3 In the event of late payment, default interest will be charged on any type of invoice, by law and without prior notice of default, in accordance with applicable Belgian law.
4.4 The Actioncenter reserves the right to charge reminder fees of 12 € per reminder.
5. Exclusivity for activities
5.1 No reservation is automatically an exclusive reservation. Other people may also participate in the activities without the consent of the other participants. Requests for private reservations must be made by e-mail. The full amount requested by the Actioncenter for exclusivity must be paid in advance.
6. On site
6.1 Check-in for reservations including kart races always takes place 45 minutes before the start of the first activity at reception. Customers with bookings that do not include karting must register at reception 30 minutes before the start of the first activity. Reservations of customers who arrive late may, if possible, be rescheduled or otherwise cancelled under the conditions of point 3.
6.2 If Actioncenter helmets are used for karting, wearing a balaclava is mandatory. This is available for 3 € at reception.
6.3 If an Actioncenter helmet is damaged, the customer is obliged to pay €75. The damaged helmet remains with the customer.
6.4 The Actioncenter is not liable for program changes or for delays that result in subsequently planned activities such as restaurant visits or other reservations.
7. Disclaimer of liability
7.1 Participation in the activities is at your own risk. Each guest undertakes to follow the safety instructions of the staff and to use the provided equipment properly.
7.2 Participants confirm upon registration that they are physically fit to safely carry out the respective activities. The Actioncenter reserves the right to exclude people under the influence of alcohol, drugs, medication, or with physical or mental impairments that may endanger the safety of others from the activities. In the event of exclusion from one or more activities, there is no refund.
7.3 The operator is not liable for damages caused by failure to follow safety instructions, improper use of the facilities or by the participant’s own misconduct. The Actioncenter assumes no liability for injuries or property and personal damage caused by failure to follow safety instructions, improper use of the vehicles or personal misconduct.
7.4 Legal guardians or adult accompanying persons are obliged to fulfil their duty of supervision and are liable for damage caused by minors or mentally impaired persons.
7.5 The Actioncenter assumes no liability for loss, damage or theft of items brought along.
8. Data protection
8.1 Photos or videos may be taken during events. By participating in the event, the customer agrees that these may be used as part of public relations work (e.g. website, social media), unless expressly objected to.
8.2 The Actioncenter observes the applicable data protection laws and treats users’ personal data confidentially.
8.3 What data is stored? – All data that the Actioncenter requires for reservation, invoicing and activities.
9. Force majeure
9.1The operator is not liable for non-performance or delayed performance of its contractual obligations if these are due to events beyond its control (“force majeure”).
9.2 Force majeure includes, but is not limited to: natural disasters, extreme weather conditions, fire, floods, power outages, technical failures, epidemics/pandemics, governmental orders, political unrest or other unforeseeable events that impair operations.
9.3 In cases of force majeure, the operator is entitled to postpone or cancel events. Payments already made will not be refunded in this case.
10. Severability clause
10.1 Should individual provisions of these GTC be wholly or partially invalid or unenforceable or become so, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, the valid regulation that comes closest to the economic purpose of the original provision shall be deemed agreed. The same applies to any contractual gaps.
11. Jurisdiction
11.1 For all disputes arising from or in connection with these GTC and the services offered, Belgian law shall apply exclusively. Exclusive place of jurisdiction for all disputes is the competent court at the operator’s registered office in Eupen, Belgium.
